Q. What is a Homeowner's Association?
A. It is a non-profit corporation registered with the State and managed by a duly elected Board of Directors. Its purpose is to maintain all common areas and to govern the community in accordance with the provision of the legal documents: CC&R's, ByLaws, and Articles of Incorporation. The corporation is financially supported by all members of the Homeowner's Association. Membership is both automatic and mandatory.
Q. What are the CC&R's?
A. The Covenants, Conditions and Restrictions (CC&R's) are the governing legal documents that set up the guidelines for the operation of the planned community as a non-profit corporation. The CC&R's were recorded by the County Recorder's office of the county in which the property is located and are included in the title to your property. CC&R's are a legal document attached to the title of your home that you agreed to abide by when purchasing your home. Failure to abide by the CC&R's may result in legal action against a homeowner by the Association.
Q. What are the ByLaws?
A. The ByLaws are the guidelines for the operation of the non-profit corporation. The ByLaws define the duties of the various offices of the Board of Directors, the terms of the Directors, the membership voting rights, required meetings and notices of the meetings, and the principal office of the Association, as well as other specific items that are necessary to run the Association.
Q. Are there any other rules?
A. You HOA has Rules and Regulations as provided for in the CC&R's and adopted by the Board of Directors. Rules are established to provide direction to the homeowners for common courtesies with regard to parking, vehicles, pets, sheds, etc. In addition, the HOA will adopt Architectural Guidelines with procedures for submitting requests to make exterior changes to your home. These rules and guidelines are set up to maintain the aesthetic value and integrity of the community on behalf of all owners, and hopefully protect the market value of your investment as well. Violations of these rules may result in legal action by the Board of Directors.
Q. Who do I call for violations of the CC&R's or other property issues?
A. For questions regarding our CC&R's or to report violations of the CC&R's, please contact River City Management. You may also notify the Board by sending an email.
Q. Who do I call for parking issues (ie, parking on the street, semi parked in the community, car blocking the sidewalk?
A. For parking issues, please contact City Services at 630-CITY (2489). It is a city issue, not an issue for the Sheriff's Office.
Q. When do I contact the management company?
A. Entrance lights are out, Architectural Review and Approval, community code enforcement, and entrance landscape issues.
Q. When is it a police or city issue?
A. Noise disturbance, solicitors, unlawful activity, speeding, on-street parking problems and unleashed animals.
